Attempt unauthorized access
Reverse engineer or copy the software
Upload unlawful, fraudulent, or harmful content
Use Tivio for spam or harassment

Violations may result in suspension or termination.

3. Account Responsibility

You are responsible for:

Maintaining confidential account access
Ensuring authorized users follow these Terms
All actions occurring under your account

Tivio is not liable for unauthorized access caused by your negligence.

4. Payment & Subscription Terms

If you purchase a paid plan:

Fees are billed monthly or annually
All payments are non-refundable except where required by law
Failure to pay may result in suspension
Prices may change with notice

Free trials or promotional plans may be modified or discontinued at any time.

5. User Content

You retain ownership of all content you input into Tivio (“User Content”).

You grant Tivio a non-exclusive license to:

Store
Process
Transmit
Display

User Content solely for operating the Services.

You represent that you have all rights necessary to upload such content.

6. White-Labeling

If you utilize Tivio’s white-label features:

You may apply your branding, domain, and styling
You remain solely responsible for content displayed under your branded environment
Tivio does not assume liability for misrepresentations made under your brand

7. Service Availability

Tivio strives for uninterrupted service but does not guarantee:

100% uptime
Error-free operation
Uninterrupted access

Scheduled and emergency maintenance may occur.

8. Termination

Tivio may suspend or terminate your access if you:

Breach these Terms
Misuse the platform
Engage in fraudulent or unlawful behavior

You may terminate at any time by closing your account.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TIVIO DISCLAIMS ALL WARRANTIES INCLUDING:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

TIVIO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.
TIVIO’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE LAST 12 MONTHS.
IF YOU ARE ON A FREE PLAN, LIABILITY IS LIMITED TO $0.00.

11. Indemnification

You agree to indemnify and hold harmless Tivio, its officers, employees, and affiliates from all claims arising from:

Your misuse of the Services
Violations of these Terms
Content you submit or manage
Disputes between you and your tenants, landlords, clients, or users

12. Governing Law

These Terms are governed by the laws of:

Province of Alberta, Canada (or your preferred jurisdiction)

Any disputes will be resolved exclusively in the courts of that jurisdiction.

13. Changes to Terms

Tivio may update these Terms at any time.

Continued use signifies acceptance.
