# How to apply a partial rent payment

> Apply a partial rent payment to the oldest open charges first, receipt the amount you actually received, and leave the rest due. A payment smaller than the balance does not make the month paid. In Florida, accepting partial rent after a nonpayment notice is not an automatic waiver, but section 83.56 requires a receipt, a court deposit, or a new notice. Other states differ. Check local law before you deposit a check on a file already in notice. This is not legal advice.

## Key takeaways

- Apply each dollar to the oldest open charge first, then the next oldest, until the money is gone.
- The receipt shows what the payment cleared and the balance still open, in dollars.
- A partial payment does not mark the month paid and may not erase a late fee the lease allows.
- If a nonpayment notice is already out, read the local statute before you deposit the check.

A partial rent payment is any amount you receive that is less than the open balance on the lease. Apply it to the oldest charges first, give a receipt for the amount you actually received, and leave the remainder showing as due. Do not mark the month paid. In some states, accepting a partial payment after a nonpayment notice changes what you must do next. Check the law for that unit. This is not legal advice.

## What counts as a partial rent payment?

Count any payment that leaves a balance. A tenant who owes $1,750 and pays $1,000 has made a partial payment. A tenant who owes $1,750 of rent plus $60 of parking and pays $1,810 has paid in full, even if the check arrived late. Look at the open balance, not at the contract rent alone.

A promise to pay the rest on Friday is not a payment. Hold the ledger open until the second amount is in the trust account. If you agree to a short plan, write the dates and the amounts, and still apply each payment when it arrives. The written plan does not zero the balance.

Treat housing-assistance payments with care. If a housing agency pays $900 of a $1,400 rent and the tenant's share is $500, the tenant's share can be the only amount the tenant owes. Read the contract before you call the agency portion "unpaid rent." The example later in this guide is a conventional lease with no subsidy.

## Which charges should the money pay first?

Apply the payment to the oldest open charge first, then the next oldest, until the money is used up. September's unpaid pet rent is older than October's rent, so the pet rent is paid before October rent is reduced. A late fee that posted on October 4 is newer than October rent that posted on October 1, so the rent is reduced before the fee.

When two charges post on the same day, apply the payment in the order you posted them. Post rent first, then parking, then other recurring charges. Write that order in your house rule so two staff members do not apply the same check two different ways. The receipt should show each charge the payment touched and the amount still open on each.

[Tivio](https://tivio.io/) is property management software for independent property managers. It applies a recorded payment to the oldest charges first and sends an email receipt. Tenants still pay by the method in the lease. You enter the payment when you deposit it.

## How do you receipt a partial payment?

The receipt names the date, the tenant, the unit, the amount received, the charges it paid, and the balance still open. It does not say "October rent paid" when October rent is only partly covered. A receipt that says paid in full, on a ledger that is not, is the document the tenant will bring to a dispute.

Use the same receipt fields you use for a full payment. [How to write a rent receipt (with a sample)](https://tivio.io/blog/how-to-write-a-rent-receipt-with-a-sample) shows those fields. On a partial payment, add one line for the remaining balance and the date you expect it, if you and the tenant agreed on a date. If you did not agree on a date, the remainder is due now, under the lease.

Give the receipt the same day you deposit the money. Email is enough when that is your house rule for every payment. Keep a copy with the ledger entry. [How to keep a rent ledger](https://tivio.io/blog/how-to-keep-a-rent-ledger) is the place the remaining balance has to match.

## What does a partial payment look like in dollars?

Here is 22 Birch Avenue, Unit 4, in October 2026. The lease rent is $1,750, due on the 1st, with a grace period through the 3rd. Parking is $60, posted the same morning, after the rent. A $35 pet rent from September 1 is still open. The lease allows a $75 late fee when any rent is unpaid after the 3rd, and you have confirmed that local law allows that fee. You post the late fee on the morning of October 4. On October 6 the tenant pays $1,000.

| Order | Charge | Date posted | Open before the $1,000 | Applied | Still open |
| --- | --- | --- | --- | --- | --- |
| 1 | Pet rent | Sep 1 | $35 | $35 | $0 |
| 2 | October rent | Oct 1 | $1,750 | $965 | $785 |
| 3 | Parking | Oct 1 | $60 | $0 | $60 |
| 4 | Late fee | Oct 4 | $75 | $0 | $75 |

The $1,000 clears the $35 pet rent because that charge is oldest. The remaining $965 reduces October rent from $1,750 to $785. Parking and the late fee stay open because the money ran out. The balance after the payment is $785 plus $60 plus $75, which is $920. The receipt says received $1,000 on October 6, applied $35 to September pet rent and $965 to October rent, balance still open $920.

If the tenant then pays $920 on October 10, that second payment clears October rent, parking, and the late fee, in that order. The lease is current only after the second receipt. Until then, your who-owes list shows Unit 4 at $920, and the owner statement shows the $1,000 you actually collected, not $1,750.

Check the late fee against the statute before you post the $75. In Texas, [Property Code section 92.019](https://statutes.capitol.texas.gov/Docs/PR/htm/PR.92.htm) allows a late fee only when notice of the fee is in the written lease, the fee is reasonable, and any portion of the rent has stayed unpaid for two full days. A partial payment that leaves some rent unpaid does not, by itself, erase that fee under that section. The percentage limits in the section still apply. Seventy-five dollars is about 4 percent of $1,750. Other states bar a fee, cap it differently, or require a longer wait. Use the rule for the unit.

## Can a partial payment affect a nonpayment notice?

It can, and the rule is local. Read it before you deposit a check on a file where you have already served a notice.

Florida is a clear example, and it is only an example. [Florida Statutes section 83.56](https://www.flsenate.gov/Laws/Statutes/2025/83.56) says a landlord does not waive the right to end the tenancy for that noncompliance merely by accepting partial rent for the period. If you accept partial rent after posting the notice for nonpayment, the same subsection says you must take one of three paths: give a receipt that states the date and amount received and the agreed date and balance still due before you file for possession; or place the partial rent in the court registry when you file; or post a new 3-day notice for the new amount. Those are Florida conditions. They are not a national rule.

Other states treat the deposit of any rent after a notice as a waiver of that notice, or they require a written reservation of rights. Some provinces use a tribunal form and a different timeline. Before you accept the money, decide which path the local statute allows, and write it down. If you are about to file a case, ask a local attorney before you deposit the check. Depositing it and hoping the ledger will explain itself later is how notices get lost.

If you are not in a notice period, take the partial payment, receipt it, and keep collecting the balance. Most months look like Unit 4, not like a court file. Build the habit for the ordinary month, and add the statutory step only when a notice is already out.

## Should you refuse a partial payment?

Refuse it when a local statute or your counsel says accepting it will waive a notice you still need, and you are not prepared to take the statute's next step. Accept it when you are inside ordinary collection, the money is real, and you can receipt the remainder. Write the choice in the house rule so the person covering the desk on Saturday does the same thing you would do.

Do not refuse a partial payment because of who the tenant is. The same fair-housing duty that governs reminders applies here. If you accept $1,000 from one lease, you accept $1,000 from another lease with the same balance and the same notice status. If you refuse, the reason is the notice status, and you can show that reason in the file.

Tell the owner the truth on the monthly numbers. Collected means collected. Unit 4 produced $1,000 on October 6, not $1,750. The remaining $920 is still a receivable. Hiding the gap until the tenant "probably pays" makes the owner statement wrong. Owners would rather see an open balance than a surprise.

## What do you tell the tenant in the receipt email?

Keep it to the figures. One version for Unit 4 is: "We received $1,000 on October 6, 2026, for 22 Birch Avenue, Unit 4. We applied $35 to the September pet rent and $965 to October rent. October rent of $785, parking of $60, and a late fee of $75 are still open. The balance is $920."

Send that email the day you deposit the funds. If a second payment arrives, send a second receipt, and say the balance is zero only when it is. File both receipts on the ledger. The tenant should be able to add your emails and reach the same number you show the owner.

Use [Tivio](https://tivio.io/) to apply each payment to the oldest charges and to send the receipt from the balance that remains.

## Frequently asked questions

### Does a partial payment stop a late fee?

Not by itself. If any rent is still unpaid after the grace period, the lease and local law decide whether a fee posts. In Texas, section 92.019 looks at whether any portion stayed unpaid for two full days.

### Which charge should the payment hit first?

The oldest open charge. A September balance is paid before October rent. A late fee posted on a later date is paid after the older rent, using the same order on every lease.

### What if I already served a nonpayment notice?

Read the statute before you deposit the check. Florida section 83.56 does not treat partial rent as an automatic waiver, but it requires a receipt with the remaining balance, a deposit into the court registry, or a new 3-day notice. Other states are stricter.

### Should the receipt say the rent is paid?

Say a charge is paid only when the money actually cleared it. Show the remaining balance in dollars. A receipt that says paid in full, while the ledger is still open, is the document you will have to explain.
